AMENDED PRACTICE DIRECTION NO 9
Application for leave by agents
An application for leave by an agent of a party to appear should be made on notice.
Leave to appear is required prior to any appearance and whether or not the agent instructs counsel.
Such application shall be accompanied by an affidavit of the agent stating :
his or her experience in advocacy in the field of anti-discrimination law
his or her level of education
resources available to adequately represent the party including office, staff, office equipment, telephone, fax, e-mail, photocopier, access to decisions of the Tribunal and other Tribunals
whether the person has been convicted of any indictable offence for any offence of
dishonesty
any current criminal or disciplinary proceedings to which the person is subject
fees proposed to be charged
an undertaking to comply with the requirements imposed upon law practices under sub-sections 308(1)(a)-(h), 308(4), 310(1), and sections 312, 314, and 315 of the Legal Profession Act 2007 (Queensland)
his or her possession of professional indemnity insurance
his or her membership of a professional body requiring acceptance of a code of ethics and submission to a
disciplinary system maintained by that professional body
The agent should furnish a copy of such affidavit to his or her client and to all other parties and shall
attest to that fact of having so furnished such copies.
Any application for leave should be made promptly by an agent upon receipt of instructions to act for a
party.
