CLASSIFICATION OF COMPLAINTS AND PROCESSES

Simple matters

Complaints involving single allegations or multiple simple, short allegations over a short time frame. Matters where there are likely to be few if any witnesses, other than the parties, or documents.

Step 1 – Registrar’s Directions hearing within 2 weeks

Step 2 – Complainant files within 4 weeks:

  1. Complainant’s Contentions (if any in addition to the complaint)
  2. Copies of any and all documents directly relevant to the complaint
  3. List of witnesses to give evidence at the hearing

Step 3 – Respondent files within 4 weeks after that:

  1. Respondent’s Contentions
  2. Copies of any and all documents directly relevant to the complaint and to the allegations in issue in the contentions
  3. List of witnesses to give evidence at the hearing

Step 3 – Conciliation conference to be held within 4 weeks after Respondent’s documents filed.

Step 4 – Registrar’s Directions Hearing within 2 weeks after conciliation conference.

Step 5 – Hearing with evidence in chief given by oral evidence.
