CLASSIFICATION OF COMPLAINTS AND PROCESSES

Middle range matters

Complaints involving a number of allegations which are not complex, or one allegations or series of allegations which has some complexity. Likelihood of a number of witnesses and documents.

Step 1 – Complainant files within 6 weeks:

  1. Complainant’s Contentions
  2. Copies of all documents directly relevant to the complaint
  3. All Witness statements that the complainant intends to rely on at the final hearing

Step 2 – Respondent files within 6 weeks after that:

  1. Respondent’s Contentions
  2. Copies of all documents directly relevant to the complaint and to the allegations in issue in the contentions
  3. All Witness statements that the complainant intends to rely on at the final hearing

Step 3 – Conciliation Conference within 4 weeks after Respondent’s documents filed.

Step 4 – Registrar’s Directions Hearing to discuss readiness for hearing and to set matter down for hearing, within 2 weeks.

Step 5 – Hearing with evidence in chief given via witness statements.
