CLASSIFICATION OF COMPLAINTS AND PROCESSES

Complex matters

Complaints where there may be a number of parties, the allegations are complex, the legal issues are complex, and there are likely to be numerous witnesses and documents.

Step 1 – Complaint files within 4 weeks:

  1. Complainant’s contentions

Step 2 – Respondent files within 4 weeks after that:

  1. Respondent’s contentions

Step 3 - Conciliation Conference within 4 weeks after respondent’s documents filed.

Step 4 - Both parties file and exchange list of documents within 4 weeks after conciliation conference.

Step 5 - Both parties conduct inspection of documents within 2 weeks after lists exchanged.

Step 6 - Both parties file witness statements simultaneously (in support of their respective contentions) within 6 weeks after Step 5.

Step 7 - Registrar’s directions hearing to discuss readiness for hearing and to set matter down for final hearing

Step 8 - Final hearing with evidence in chief given via witness statements
