Address for Service - complaints

The recent decision of Member Savage in Law v Surfside Buslines Pty Ltd & Ors [2004] QADT 38, highlights the need for clarity in providing a notice of an address for service, or change of address for service.

A letter from a party’s solicitor advising of instructions that all correspondence should be directed to that solicitor, was held not to constitute a notice of change of address for service.

The Commission is developing a form of address for service which will be made available for downloading from the Commission’s website.

In the meantime, practitioners are asked to have their clients provide express written notice of an address for service or change of address for service.
